Information and Privacy Analyst for provincial government ministry client, North York facility.


Marberg Job Number: 2256.

Job Type: Temporary.

Initial Term: From May 21 2024 to August 23 2024.

Compensation: $37.20 per hour.

Regular Work Hours: 7.25 hours per day not including 1 hour unpaid lunch break, to be worked during regular business hours, Monday to Friday (36.25 work hours per week).

Work Location: 100% onsite at client's North York office, near TTC station.


Responsibilities Summary:

To provide research, analytical and evaluation services under the Freedom of Information and Protection of Privacy Act (FIPPA), including acting as FIPPA program resource to all provincial ministries and multiple public bodies subject to the Archives and Recordkeeping Act (ARA). To proactively review and advise on access to restricted records, and to contribute to the further development and refinement of policies and procedures governing access. To maintain effective relationships with all stakeholders, and to provide assistance to members of the public on records access in accordance with legislation.

  • Interpret and apply FIPPA to access requests and privacy-related queries. Review records, recommendations and other documentation to ensure they are guided by legislation. Evaluate materials and proposals, including precedents and privacy orders. Determine appropriate access recommendations, and anticipate risk and impacts. Determine proper application of exemptions or exclusions.
  • Conduct research and evaluation of designated records to determine and assess potential issues regarding their release, prior to preparation of responses. Develop and maintain a precedent system of decisions, appeals, case law and legal opinions to inform decisions.
  • Conduct extensive research, review and analysis of applicable court files in accordance with Ministry of Attorney General's Court Services policies and procedures on public access to court files, documents and exhibits. Recommend approval or denial of requests, in consultation with Legal staff.
  • Prepare records for disclosure in response to FIPPA requests, and maintain correspondence regarding decision letters, calculation and collection of estimate fees, time extensions, and consultations with other ministries.
  • Provide advice, recommendations and coordination to ministry clients, ensuring all statutory requirements are met and appropriate exemptions applied (both FIPPA and ARA) to determine response.
  • Deliver complete, thorough and accurate communications to senior management for consideration in decision-making.
  • Contribute to issues management process, including preparing briefing notes and presentations related to FIPPA access requests, complaints, inquiries, appeals, and privacy issues.
  • Identify and manage complex and contentious access and other related legislative issues, appeals and mediations involving the investigation and application of relevant precedents or case law, to determine granting or denial of access. Ensure supporting information is easily retrievable in the event of an appeal. Coordinate and liaise with affected ministries to ensure an integrated response and consistent application of FIPPA requirements.
  • Act as liaison between the Privacy Commissioner and clients in the case of appeals to FIPPA access decisions.
  • Advise and update branch management and staff on government policies, guidelines and directives, and facilitate inclusion of FIPPA requirements into archival policies and practices.
  • Additional FIPPA related research, analysis and advisory responsibilities as required.


Qualifications:

Education: Post Secondary Degree in relevant discipline. Related post graduate education and training a strong asset.

Preferred Work Experience: Approximately 4+ years of relevant professional experience or equivalent combination of education and work experience.

Preferred Sector Experience: Public, broader public, and/or legal sector experience related to access to information and privacy issues.


Technical and Language Skills Requirements:

  • Proficiency with standard software programs and tools to manage projects, and prepare reports and presentations.
  • Expert level English reading comprehension skills and written and verbal communications skills.


Task -Based Qualifications and Additional Attributes:

  • Sound knowledge of access and privacy issues, trends, and precedents.
  • Expert level research, analysis and policy interpretation skills, in order to interpret and apply FIPPA legislation, program principles, directives and guidelines, access and privacy theories, and principles and best practices to both enterprise and public FIPPA requests.
  • Familiarity with Ministry of the Attorney General's policies and procedures on public access to court files, documents and exhibits.
  • Demonstrated record of professional conduct and character. Responsible, reliable and works to deadlines.
  • Pleasant and courteous. Demonstrated commitment to client service and professional representation of the organization. Proficient de-escalation skills.
  • Proven ability to respond to sensitive and confidential matters with tact, discretion, and excellent judgement in the interpretation and application of instructions and organization policy.
  • Demonstrated ability to work well both independently and collaboratively, and in an advisory capacity, and liaise effectively with a wide and diverse range of internal and external stakeholders.
  • Demonstrated successful experience of prioritizing work, making decisions and communicating with others within a values framework of respect, equity, anti-racism, diversity and inclusivity.


Additional Requirements:

  • Must be legally entitled to work in Canada, providing satisfactory documentation upon request.
  • Ability to work either 100% onsite or on a hybrid basis as required, abiding by organization health and safety policies.
  • Ability to declare personal Non-Conflict of Interest in execution of assignment responsibilities.
  • Ability to complete a satisfactory Provincial Government security check, which may include a Fingerprint Check, prior to assignment start. Please note that Marberg will reimburse for the cost of the security checks upon confirmation of assignment start and submission of approved expense receipts.
  • Provision of certification of AODA and OHSA online training course completion prior to assignment start.
  • Additional satisfactory Background Checks, Technical Skills Evaluations, and Employment References as required.
